Lex specialis allowing opposition to enter the government submitted to Parliament

The text of lex specialis, which have been signed by URA Civic Movement and Demos, points out that it is necessary to be put on Parliament’s agenda under urgent procedure and MPs might discuss it as early as on Thursday.

In addition to the lex specialis, at that session the very members of the interim government would be discussed, as well as the dismissal of the Parliament Speaker Ranko Krivokapic.

Official signing is expected tomorrow, but, as Krivokapic previously said, there will be no joint signing, but the party will exchange documents among themselves.

According to the agreed text of the agreement, the opposition will get ministerial posts in the Ministry of Finance, Ministry of Interior, Ministry of Labour and Social Welfare and the Ministry of Agriculture, a deputy prime minister’s post, as well as posts of assistants with special powers in the ministries of health and education.

In addition, the opposition will get more than 50 posts in state-owned companies, as well as about 150 posts on the administrative and advisory levels.

The Lex Specialis will enter into force when the new government’s members are appointed and will be valid to establishing the final results of the general elections. The opposition representatives will have access to the decisions made in the sectors of their jurisdiction from the beginning of this election year.

“The lex specialis has been given in the procedure today. There were no major problems, and I think that allows us to move to the next phase, because this one really lasted very long”, said the URA’s representative Dritan Abazovic.

The document stipulates that those who will be appointed to the posts in the administration on the basis of a political agreement are to be selected by the government, without public competition. Contracts on permanent employment may not be approved without a signature of opposition representatives. Their signature will also be necessary for using state resources. The aim is to prevent any possibility of abusing public property for electoral purposes.

Abazovic said that the agreement was signed by URA and Demos today.

Thursday is a realistic term when the lex specialis could be presented before MPs. According to Prva TV, this is the reason why the agreement was not signed by SDP, the leader of which wants to postpone the session until the next week. In addition to the law, his dismissal will also be discussed at the session.

According to unofficial information, Ranko Krivokapic is so committed to the postponing, that it is possible he will not sign the agreement. Even if that happens, implementation of the agreement will not be endangered, because SNP announced it would support the lex specialis.

The latest issue that is discussed is the status of the Positive Montenegro. Prva TV unofficially reported that the party would enter the government, but not as an opposition party.

Ministers from the opposition will be able to hire two advisors and one administrator. The head of the Interior Ministry is entitled to three advisors.

The institution of countersignature has also been included in the lex specialis.

The CdM news portal earlier explained the concept of the countersignature.

For example, it will take two signatures for passing decisions in certain places in the government such as the ministries of health and education, as well as in some agencies and administration authorities. It shall not be applied to each post.
