Two versions of lex specialis: They want the law to determine who’s the opposition and who’s not

Dnevne newspaper had insight into both versions. Differences are visible at the very start which will obviously be a subject of discussion for the parties participating in this process and the government. URA, Demos and SDP are trying to determine who’s the opposition in Montenegro by this law. By their proposal SDP would be declared opposition although they still have a significant number of members on management positions in public administration. On the other hand, Pozitivna would be part of the regime although they are the one who initiated the agreement conversation on the oppositon side and if this would be accepted, the government would have to provide positions for Pozitivna from their own part, and not from the part assigned to the opposition. This article would also set Democratic front as the opposition although they didn’t even participate in the process. 

On the other hand, the Government’s proposal doesn’t deal with this issue in their version of lex specialis. This article in lex specialis is likely to cause new political turbulence in Montenegro. According to the statement of the president of SNP Srdjan Milic, they still didn’t see the draft version of lex specialis so they still don’t know if it’s acceptable for them. 

In two different versions of the draft that Dnevne newspaper had insight into, there are further diferences. The proposal of the opposition includes employment of a lot more people in public administration than it was originally agreed upon, because the government’s proposal includes only positions that were discussed for the agreement, while the opposition’s proposal would mean tens of employees more as administrative staff, secretaries, drivers and so on. Also, there are some differencies in terms of the requirements for the people who would fill in the positions in the public administration on behalf of the opposition. 

In any case, we can expect more discussion about lex specialis, and a joint version has to be presented to the parliament members because the issue is the law for implementation of the agreement on provision of conditions for free and fair elections.
