The Court of Appeals delivered its judgment after the meeting of its Council, held on March 2nd.
The Trial Chamber of the High Court in Podgorica, which was presided by Judge Vesna Moštrokol, imposed last year a compound sentence of 19 years of imprisonment for Damir Mandic, charged with complicity in the murder of the chief editor of Dan daily, Dusko Jovanovic.
It was the third trial conducted in this case, when Mandic was first released, and then sentenced to 30 years in prison.
The Court of Appeals reversed the earlier ruling and Mandic was sentenced to 18 years in prison, but this verdict was also overturned.
In his complaint, which was read on March 2 in the Court of Appeal, Mandic pointed out that the renewed court proceedings before the High Court did not treat him according to the decision of the Constitutional Court of Montenegro, but only gathered to meet the form and re-sentence him.
The Court of Appeals has now ruled that the trial court properly evaluated the defense of the accused Damir Mandic and all the presented evidence, that it correctly established all decisive facts relevant for establishing the existence of a criminal offense of attempted aggravated murder and the guilt of the accused Damir Mandic.
