Bankruptcy trustees will be needing work permits

Trustees in bankruptcy will have to possess work permits and in order to be able to perform their duties. According to Dnevne Novine daily, the draft Law on amendments to the Bankruptcy Law stipulates trustees will be able to perform their duties provided that they:

-possess at least 5 years of work experience with a university degree;

-are mediacally fit to perform given tasks;

-are Montenegrin nationals;

-haven’t been convicted of a criminal offence making them unworthy to perform their tasks and against whom there are no pending criminal proceedings for a criminal offence prosecuted ex officio.

-have passed professional examination;

-are found on the List of bankruptcy trustees.

The Ministry of Justice will be issuing work permits for them, lasting for 5 years and they will be able to extend the permits for the same period of time.

“The Ministry of Justice can reject a request for extending the work permit of trustees in bankruptcy in case he/she does not pass the professional examination,” the Draft Law suggests.

Also, the work permit can be declared invalid upon the request of the Montenegrin Commercial Court.

Draft Law on Amendments to the Bankruptcy Law says justice minister is in charge of defining the professional exam fee, and he/she is the one to establish the commission for the testing procedure. The commission members are elected for a period of two years.
