Castellana sued Hipotekarna Bank for charging loan processing fee

Castellana Company sued Hipotekarna Bank because it charged the loan processing fee amounting to EUR 6,700, but failed to elaborate the reason of charging in the loan agreement. Hipotekarna Bank, on the other hand, told CdM the suit is groundless and they will wait for the finalization of the court proceedings.

Miloš Vukčević, duly authorized representative of Castellana, said that even on the first trial this bank failed to explain reasons behind charging a fee. This is why a financial expert has been engaged and he/she is to set out the findings and opinion on the trial scheduled for 27 November.

Vukčević added that today he submitted judgments of the Appellate Court in Belgrade and High Court in Sombor in cases similar to this one. Castellana did not clearly denote for which services they charged a fee, and according to him, the clause of the agreement referring to it is unfair and a total nonsense, as it’s in contravention of the Law on Obligations.

Vukčević also underlined that Hipotekarna Bank has been continuously repeating the charges referred to the loan-processing fee, without elaborating the exact costs it had in this concrete case.

Hipotekarna Bank, on the other hand, said the suit was groundless.
