Kos: The Agreement does not contain detailed provisions in conflict with the EU acquis

The Agreement on Cooperation in the Field of Tourism and Real Estate Development between Montenegro and the United Arab Emirates (UAE), prima facie, does not contain provisions detailed enough to be in conflict with the EU acquis, the opinion of the European Commission (EC) on the mentioned agreement says.

“As you noted in your letter, all international agreements Montenegro signs should be in line with the national constitutional and legal framework, the EU acquis, as well as the Stabilization and Association Agreement between Montenegro and the EU. Based on the analysis of the EC, the Agreement on Cooperation in the Field of Tourism and Real Estate Development, prima facie, does not contain provisions detailed enough to be in conflict with the EU acquis,” says the letter from the European Commissioner for Enlargement, Marta Kos.

However, she adds, “certain provisions need to be implemented carefully in order to avoid possible infringement of the public procurement principles of EU law. Therefore, it is important to monitor their application, as such situations should be avoided”.

Ms Kos also notes, among other things, that considering Montenegro’s aspiration for EU membership, it would be of paramount importance to ensure that the Agreement is aligned with the EU acquis in the field of public procurement, that is, it should be based on the principles of non-discrimination, equal treatment of companies and transparency in the public procurement procedures.
