Ninety complaints about the work of judicial authorities

In 2019, Ministry of Justice received 90 complaints about the work of judicial authorities, and that’s by 75% less than in 2018.

Nine applications referred to the work of the notary and 47 applications referred to the work of public officials.

Last year Ministry carried out the supervision of courts and prosecutor’s offices and established one irregularity in the Court in Bijelo Polje which referred to the conclusion of registers and decision on putting registers of settled cases into archives.

During 2019, inspectors of the Directorate for civil legislation and supervision, have totally completed Annual plan of supervision over the lawfulness of the activities of the notary and the notary chamber, as well as Annual plan of supervision over the work of public servants and the Chamber for 2019.

“Two proposals for the initiation of disciplinary procedure concerning public servants have been submitted, three complaints for the establishment of disciplinary accountability and three lawsuits for the annulment of the decisions rendered by the Second-degree disciplinary commission for the establishment of disciplinary accountability of a public servant”, the report states.

Fourteen controls over the work of the Administration for the Execution of Criminal Sanctions

Ministry of Justice has carried out 14 controls over the work of the Administration for the Execution of Criminal Sanctions.

“The Ministry received 54 applications for pardon. Eleven were rejected and one case was repelled. Montenegro’s president rendered 58 decisions while taking into consideration cases from the earlier reporting period”, the report states.

1.611 conditional sentences in one year

In accordance with the Law in Criminal Procedure, 50 cases referred to ungrounded deprivation of liberty.

Six complete agreements on the existence of damage have been concluded.

Ministry of Justice rendered decision in 15 cases on the request for the termination of prison sentences.

There were 292 cases for the execution of the sentence of public-interest work in 2019.

In 2019, 1.611 cases of conditional sentence were received. There were 315 cases of conditional release.

126 decisions on rehabilitation

Data concerning physical persons and legal entities and minors have been updated, as well as 930 discharge lists.

Around 126 decisions on lawful rehabilitation have been adopted. Ministry declared itself incompetent in relation to 63 requests.

Ministry has prepared opinions on the provisions of 118 regulations stipulating the procedure before courts, sanctions and misdemeanor procedure.
