Serbia refused to extradite Bogicevic

Special court in Belgrade denied Montenegro’s request to extradite Serbian National Predrag Bogicevic, who is a suspect in the investigation on attempted terrorist attack on October 16th in Podgorica.

There is no possibility to appeal this verdict, however it will be sent to Appelate court in Belgrade for final say. This court previously denied to extradition of Nemanja Ristic, suspect in the same case.

Criminal council of Special court refused the request based on the provision in Law on international legal help in criminal affairs, as well as Criminal Code, Law on crime procedures as well as a provision in the Contract between Serbia and Montenegro from May 29th 2009.

“Investigation demonstrated that Bogicevic took action on Serbian territory so there were no conditions to extradite him to Montenegro”, Belgrade court concluded.

Appelate court will hold a hearing and reach the final decision. Bogicevic spent a month and a half in remand, and was let go on February 24th, while Ristic was never incarcerated.

Higher court in Kragujevac put Bogicevic in remand, and passed a decision that granted Montenegro’s request, however the decision was changed by Appellate court in Kragujevac.

Montenegro holds Ristic and Bogicevic suspect in investigation on criminal organization and terrorism based on Criminal Code of Montenegro. Bogicevic and Ristic were arrested in Kragujevac and Belgrade on January 13th on international warrant from Montenegro.

The warrant was also issued for two Russian nationals. All are supects in investigation on attempted terrorist attack. Montenegrin Prosecution is in procedure against a group of 18 Serbian nationals, most of them in remand in Podgorica. Some of them signed a plea bargain with Montenegrin Prosecution.
