Tenants must pay maintenance even without a building manager: Debts can be collected

Apartment owners cannot avoid paying building maintenance costs simply because their building was temporarily without a property manager.

The Ministry of Spatial Planning, Urbanism and State Property clarified that the obligation comes directly from the law and continues even when no manager has been appointed. Unpaid monthly contributions for such a period can therefore be collected if a valid decision by the owners’ assembly had established the amount of the monthly payment.

The fact that no maintenance work was carried out during that period does not, by itself, remove the obligation to pay.

A new property manager also does not have to recalculate or establish previous debts if they receive properly documented records from the former manager. However, they are required to take legally prescribed steps to collect outstanding debts when their basis, period and amount can be reliably established.

Maintenance bills are enforceable documents, and if an owner fails to pay for more than three months, the manager must initiate enforcement proceedings within eight days.

In short, neither a change of manager nor a period without one automatically cancels existing debts.
