“The Administrative Court of Montenegro has not yet considered the complaint of Ivan Brajovic, because the response to the complaint hasn’t been submitted yet, as well as records of cases by the defendant authority, or the Interior Ministry”, the court stated for CdM news portal.
The Administrative Court forwarded Brajovic’s lawsuit to the Ministry for formal declaration on the matter, so that they can complete the files.
The Ministry of Interior headed by Rasko Konjevic, who is also vice president of Social Democratic Party (SDP) and former party colleague of Brajovic, rejected the application for registration of the Social Democrats explaining that such a name (Social Democrats) might cause confusion in the public due to the fact that SDP is already registered as the Social Democratic Party.
“The application for registration of the Social Democrats of Montenegro was rejected pursuant to section 13 paragraph 1 of the Law on Political Parties, which stipulates that the name, short name and the party label must be different from the name, abbreviated name and designation of the other registered party or a party that ceased to exist provided that the date of the termination has not been less than four years ago, and must not be such as to bring citizens into confusion or violate their moral feelings”, the Ministry announced to the CdM.
The Social Democratic Party previously asked the interior minister Rasko Konjevic to not allow a newlyformed party led by Ivan Brajovic to be officially registered under the name of Social Democrats of Montenegro.
The Social Democrats of Montenegro reacted by announcing a lawsuit against the Minister of Interior Rasko Konjevic should his department refuse to register the party under their chosen name, which they followed through by suing him with the Administrative Court on September 9th 2015.
The SDP split on June 30th, when its Central Committee rejected the platform for the preservation of the unity of the party offered by Brajovic, who then announced that the wing of the party which supports him is leaving the SDP.
Since then, in almost all municipalities the new party formed municipal councils of SD, as well as boards of Youth of Social Democrats.
