Bailiffs blocking accounts without notifying

From this institution was said to Vikend newspaper that the proposal for new Decree for the tariff of the bailiffs is already prepared and that it’s in procedure for being officially applied. 

In which direction will the changes go remains to be seen. In a year and a half since bailiffs were introduced and operational, according to Vikend newspaper information, unsatisfied citizens filed several hundreds objections to the court and the relevan chamber, pointing out many irregularities in their actions.  

Main objections are exceeding their jurisdiction, not notifying the debtor about the debt collection, so it often happens to citizens that when they go to take their salary or pension from the bank, they find out that they’ve been blocked or that funds have been taken from their account. 

That is why it’s not surprising that many citizens think of the bailiffs as of “inquisition” that would take “even their souls” just to collect someone’s debt, in which they also collect a good reward for themselves. 

The vagueness in the Law of bailiffs and the Law of collection and security of payments was pointed out by Lawyers chamber of Montenegro, which filed an initiative to Constitutional court over a year ago asking for an opinion on their constitutionality. 

Lawyer of the Center for consumer protection (CEZAP) Dragomir Calasan said for Vikend newspaper that bailiffs have a big problem considering the small number of them compared to the huge number of cases.
