Administrative Court: Govt. dismissed Brdjanin illegally

The former head of the Police Directorate, Zoran Brdjanin, was illegally dismissed on 30 March this year, the Administrative Court of Montenegro has found.

The Court has annulled the decision of the Government of Montenegro, which determined the termination of Brdjanin’s term before the expiration of the term which he was appointed for.

It is further stated that the Court finds that the Government, when passing the contested decision, incorrectly applied the provision of the Law on Civil Servants and State Employees, given that the Police Directorate is not an independent administrative body, but, in terms of the Law on Internal Affairs, it is an organizational unit of the Ministry, referred to by the Decree on the Organization and Mode of Operation of the State Administration, which provides for administrative bodies, excluding the Police Directorate.
