Children shouldn’t be victims of marriage breakdowns

In the process of marriage divorces, parents, probably because of their own conflicts, forget that they violate what is in the best interest of their child, since they expose the child to all the discomforts that the judicial epilogue brings.

That’s what the judge in the High Court in Podgorica and the chair of the steering committee of the Centre for Training in Courts and State Prosecutor’s Office, Senka Danilovic, told Pobjeda. She believes that everyone involved in the decision-making process, particularly when it comes to who will get the guardianship of a child, must be guided by the best interest of the child. Temporary measures are the way to alleviate uncertainty and negative consequences in long judicial proceedings, she explains.

She said that divorce litigations were the most difficult for judges, “not because of their legal complexity, but because the weight of the decision the court makes, which determines future life of a child”.
