Vesna Bratic trial for failing to meet the requirements stemming from the Law on Free Access to Information scheduled for 10 November wasn’t held because the Misdemeanour Court couldn’t deliver her the invitation to attend it, a member of the Council of the Agency for Protection of Personal Data and Free Access to Information, Muhamed Gjokaj, told Pobjeda daily.
“The trial was postponed for February because the Misdemeanour Court couldn’t find the exact address of Bratic in order to hand her the invitation to attend it. They explained that she had changed her address. There’s also a possibility that she actually wished the statute of limitations to happen”.
However, senior legal advisor of the Centre for Civic Education, Snezana Kaludjerovic, explains to Pobjeda daily that the Misdemeanour Court has certain legal options to submit documents to parties, which is particularly easy for persons performing public jobs – Ms Bratic is full professor at the Faculty of Philology of the University of Montenegro.
If they can’t deliver the invitation in that way, she adds, they may submit it any time, any place. “This means that the delivery can be done during her classes at the faculty, but before that, a court official who’s doing it must know her schedule and the place where lectures are being held
