In 2018, European Court of Human Rights issued 13 judgments against Montenegro, states the Report produced by the European Commission. Most cases concerned Article 6 of the European Convention on Human Rights – right to a fair trial.
“Two cases concerned Article 8 of the European Convention, (right to respect for private and family life), two cases concerned Article 1 of the Protocol No.1 (right to property), whereas one case was related to Article 13 – right to an effective remedy. Violations were found in 11 of these cases”, reads the Report.
Overall awareness of the institutions and rights protected by the European Convention of Human Rights is increasing. Improvements are still needed regarding the application of ECtHR standards and
the quality of reasoning of decisions referring thereto.
“Montenegro has reached stable level of cooperation with the European Court of Human Rights and none of the judgments are subject to enhanced supervisory procedure. The Government continues to conclude friendly settlements in cases concerning the length of proceedings and non-enforcement of domestic decisions”, reads the report.
