The Agency for the Prevention of Corruption analysed the provisions of the Draft Law on Labour and found that there was a risk of endangering the public interest by arbitrary interpretation of the law due to the wide discretion given to employers, undefined norms, inconsistencies with international sources of law, which could impair the integrity of transparency and legal certainty, the agency says in its opinion released yesterday.
The agency has specifically analyzed the provisions related to the establishment of employment, the rights and obligations of employees, the protection of employees’ rights, sick leave, employment through agencies and dismissal.
“In order to protect the public interest, the agency suggests considering the amendment of the articles of labour law through compliance with the international standards the proposer invokes in the reasoning, in order to fully achieve the protection of the public interest by defining adequate procedures and criteria and reducing the discretionary power of employers”, the agency says in the opinion.
