Fines up to 40.000 EUR for polluters

Legal entities and physical persons that did damage to the environment or provoked immediate danger to the nature, will be obliged to pay the costs caused by the pollution of the environment, stipulates the Law on Industrial Emissions.

With the introduction of the principle “the polluter pays”, companies whose facilities pollute the environment will bear the costs for endangering environment and putting it at risk, as ell as the costs of bringing the location back into its original state.

According to the proposed provisions, any legal entity that starts its business in a facility without permission, if it fails to deliver report on measuring once in a year, if it fails to deliver to the management authority results of the monitoring of emissions into the land, air, water, sea and other segments of the environment in accordance with the license, will be punished by a fine ranging from 5.000 up to 40.000 EUR.

The greatest polluters in Montenegro are Thermal Power Plant in Pljevlja, Aluminum Plant Podgorica and Ironworks in Nikšić.

The licence will stipulate the measures of the protection of land, air, water and sea and will be issued for the period of ten years.

Article 59 of the Law forbids the application of production processes in which mercury or its compounds are used. The exception is the equipment required for the protection of natural security, including weapons, munition and military materials predicted for military purposes, equipment intended for space missions…
