Former president of the Municipality of Berane and a Democratic Party of Socialists (DPS) member, Vuka Golubovic, his brother Milan Golubovic and former heads of Berane cadastre Darko Malisic and Momcilo Sajicic have been suspected of costing municipal budget €532,590 abusing their office, Special State Prosecutor’s Office (SDT) says in its investigation order, Pobjeda newspaper reports.
In addition to them, the investigation includes the owner of a land survey company Vuceta Malisic and owner of the Tehnostar company Zarko Barjaktarovic for abuse of office by assisting.
According to the order, signed by the prosecutor Tatjana Zizic, Vuka Golubovic is charged with costing municipal budget a total of €192,761.
By a contract concluded in 2011, Golubovic exempted the Berane-based investor company Tehnostar Izgradnja from paying €28,273.26 new construction utility connection fee, with no legal grounds.
The company planned to build a business-residential facility (a total area of 2,560.27 square meters) on a municipal plot.
Golubovic exempted the Tehnostar company from paying the fee, groundlessly citing the decision of Berane Municipal Assembly, which referred to the Izgradnja Berane municipal company. According to that decision, Izgradnja Berane was exempted from paying the fee for constructing a building on another cadastral plot.
According to the same model, Golubovic exempted Tehnostar from paying utility connection fee twice more, thus costing municipal budget €15,346.53 in each case.
According to the order, in September 2012, Golubovic concluded a claim assignment agreement worth €57.200 with the Integral Engineering company, which assigned its claims against the municipality of Berane to the Vihor company.
However, on the day of conclusion of the cession contract Integral Engineering’s claim against the municipality amounted to €24,730.44. This means that the municipality paid €32,496.67 more than it should have. Since Golubovic did not submit the assignment contract to the municipal accounting department, the Municipality of Berane continued its payments to the Integral Engineering. Thus, €25,700 was paid to the company on 28 September 2012. A half a year later, on the basis of the contract the Vihor company collected €32,496.67 from the municipality. In this case the municipal budget was bilked €58,169.78.
In the same way, based on the assignment agreement, Golubovic wrongfully paid €30,000 to Scekic Promet company, thus harming the municipality of Berane.
On 26 November 2012, Golubovic approved Tehnostar’s claim and let this company register ownership over cadastral plots which belonged to the municipality, thus costing the city budget €45,600.
Former heads of Berane cadastre Darko Malisic and Momcilo Sajicic have been charged with registering municipal land worth €334,829 as Tehnostar’s property with no legal basis. Land surveyor Vuceta Malisic was an assessory to this offence.
Among other things, SDT determined that the state-owned land of the bankrupt construction company Izgradnja was illegally registered as Barjaktarovic’s property. According to unofficial information, in his statement to prosecutor, Barjaktarovic said that he had bought the disputed land from the Izgradnja company and then registered it as Tehnostar’s property in accordance with the law.
