The Administrative Court has passed the lawsuit of the former representative of Montenegro before the European Court of Human Rights, Valentina Pavlicic, thus overruling the government’s decision to dismiss her. The government is now obliged to pay Ms Pavlicic €400 for legal costs.
The Administrative Court of Montenegro first determined that the Government of Montenegro violated provision 22 of Article 7 of the Law on Administrative Procedure, as if failed to justify her dismissal, that is, the justification just said that she was dismissed on the proposal of the minister of justice submitted to the government, noting that it (government) had considered the minister’s proposal and accepted it.
However, as the court says, considering this justification, they couldn’t determine the reasons and legal basis for the dismissal of Ms Pavlicic, particularly having in mind that articles 7 and 8 of the Decree on the Representative of Montenegro before the European Court of Human Rights prescribes the reasons for the termination of office of the representative.
For this reason, the Administrative Court adopted the lawsuit and struck down the government’s decision.
