Lawsuit against Hipotekarna Bank

“Castellana” Company from Podgorica and Hipotekarna Bank are involved in the litigation because this Bank charged “Castellana” at 95.111, 87 EUR on behalf of the premature loan repayment. Trial session scheduled for today at the Commercial Court was postponed since the representatives of the Hipotekarna Bank didn’t turn up for it.

„Hipotekarna Bank delivered to “Castellana” the invoice which didn’t have invoice number on it and it also charged the 3% interest, which isn’t in accordance with the Loan Agreement signed in 2015“, it is stated in the lawsuit.

Proxy of the “Castellana” Company, attorney Dragoljub Petrović, points out that Hipotekarna Bank didn’t precise the tariff for the premature loan repayment.

„The defendant obviously arbitrarily determined the percentage of the fee for the premature repayment of the loan, although the decision on the tariffs for the compensation of the bank hasn’t been integrated in the Agreement. The applicant hasn’t agreed on that percentage of the fee“, it’s stated in the lawsuit.

Owner of “Castellana”, Anton Vuljaj, said he had decided to file the lawsuit after a very long time.

„This is the only way to compensate the damage this Bank caused us. We won’t give up on this litigation, and I’m even ready to go and claim  my rights in Strasbourg, but, hopefully, this won’t be necessary“, said Vuljaj for CdM.
