The Assembly of the Notary Chamber of Montenegro has proposed new standardised fees for notary services, covering contracts, certifications, deposits, and probate procedures.
The proposal sets fixed and value-based pricing depending on the type of service, with notaries required to apply the same tariff in every case and act most cost-effectively for clients. Fees are generally calculated based on the market value of the transaction, time spent, or as fixed amounts. Charging above or below the prescribed rates is prohibited.
Key examples include €180 for contracts up to €20,000 (with fees increasing for higher values, capped at €8,000), €3.50 for signature certification, and small fixed fees for services like powers of attorney, certificates, and document storage. Discounts are provided for vulnerable groups, who may pay only 40% of the standard fee.
A separate tariff regulates notaries acting as court commissioners in probate cases, with fees starting at €65 and capped at €350 depending on the estate value. Notaries will collect these fees directly from heirs.
The new tariffs will take effect once published in the Official Gazette, replacing the current system from 2012.
