Maksic’s out on pre-trial release?

The Constitutional Court of Montenegro has rejected the decision taken by the Appellate and High Court of Montenegro on extension of detention for a Serbian citizen Dragan Maksic, accused of being involved in the alleged coup attempt. The Constitutional Court also adopted the constitutional appeal of Maksic’s attorney, Aleksandar Vojinovic, against the decision of the Appellate Court, and the case will be returned for it to be decided again. The accused Dragan Maksic has spent almost 14 months and 15 days in detention.

The justification of the Constitutional Court cites the accused Maksic submitted a timely appeal  against the decision of the Appellate and High Court, and reasons he mentioned were inadequate and unclear, but the Criminal Procedure Code explicitly requires considering of alternative measures for imprisonment.

Chief special prosecutor Milivoje Katnic firmly opposed a request of the defense attorney to release Dragan Maksic, Srboljub Djordjevic and Milan Dusic from detention, stating the accused were “young and vigorous”.
