Right to 90-day refund under Consumer Rights Act

A consumer should know that if he/she informs the trader about a faulty product within 90 days after the purchase, he/she is entitled to demand repair, replacement, price reduction or termination of the contract with a refund.

This is what Ms Nada Đurđić of Montenegro’s Administration for Inspection Affairs told in an interview with PR Center, on the occasion of 15 March – World Consumers Rights Day. She explained that the Consumer Protection Act defines the protection of consumers’ rights in trade, especially the protection of consumers’ economic interests, legal protection, information and education, association of consumers in order to protect their interests and other important issues for consumers.

When it comes to faulty goods, a consumer can file a complaint to a trader within 2 years ‘having in mind the given guarantee and the deadline from a guaranteed list, within 8 days from the day of payment at the latest, and as for services of public interest – within 15 days from the day of taking a receipt.“

According to her, last year, market inspection received over 1,220 different initiatives of citizens who wanted their rights to be protected.

“When it comes to consumers and their rights, the market inspection received 659 requests for the protection of consumers’ rights,“ Ms Đurđić noted.

Citizens mostly complained about the prices (violation of regulations related to prices, payment of products, as it often happens to have one price labeled on a product and the completely another one at a cash register).

In 69% of cases, she added, requests were solved in favor of consumers, i.e. they got their money back, and were enabled to change a product or to buy another one at exactly the same price or quantity.
