Prosecutors and lawyers are on opposing sides in their professions and they represent opposing interests. The prosecutor defends the indictment, and the client’s lawyer – the defendant. The Prosecutorial Council is a body that judges the work of prosecutors – evaluates their engagement, decides on their selection, promotion or dismissal. Judging by the fact that as many as 15 lawyers applied for five members of the Prosecutorial Council from the ranks of eminent lawyers out of 16 registered candidates, it could happen that the professional fate of a prosecutor is decided by his “enemies” from the courtroom, Pobjeda reports.
The issue of conflict of interest will inevitably be opened in the new composition of the Prosecutorial Council. According to the amended Law on the State Prosecutor’s Office, there are five representatives of prosecutors, five eminent lawyers and a representative of the Ministry of Justice in this body.
