There will be problems: Personal bankruptcy will not go that easily

„In the process of adopting the law for personal insovlency parliament didn’t ask for opinion of the Central bank, so we didn’t particularly analyze solutions created by this law. That’s why we cannot comment on it right now”, it was said to Pobjeda from Central bank. 

The opinion of Commercial court was not requested either during the process of adoption. 

Andrija Popovic from Liberal party who proposed the law also said that he expects some problems in application of the law, but that he believes that it will be successful. He reminded that the law provides a possibility to citizens with big debts to have a certain period of time to repay their debts towards banks, leasing companies, and other institutions. 

Bank ombudsman Dr Halil Kalac said to Pobjeda that a detailed analysis needs to be done so that law could be applied properly. 

„By adopting this law Montenegro is undoubtedly closer to EU. This law is pesent in developed economies and in our neighbour countries Slovenia and Croatia. There are many citizens of Montenegro that would go into insolvency and whose property is endangered. Law should provide the possibility for citizens who have big debts to recover from that situation, without jeopardizing their existence, and for creditors to get their money”, said Kalac. 

In Montenegro over two billion euros has been issued in loans, and many citizens accumulated big debts for electricity and other utilities.

Insolvency procedure over a citizen is also a responsibility of the Commercial court.
