In order to improve the efficiency of the Special State Prosecutor’s Office (SDT), the Government proposed amendments to the Law on SDT and sent them to the Parliament of Montenegro for adoption. This legal act will be presented to MPs next week as part of the laws required to obtain the IBAR.
The proposed amendments to this regulation refer to the reduction of the SDT jurisdiction in relation to criminal offenses with an element of corruption, as well as the introduction of the concept of a high-ranking public official for whom this prosecutor’s office would be competent.
“Through the very broad definition of the term public official, space has been created for prosecuting persons who, objectively, according to the position they hold, would not be included in the circle of persons whose illegal behaviour could and should be treated as high corruption”, the Government points out.
That change would reduce the SDT jurisdiction related to high-level corruption crimes committed by high-ranking public officials.
“In this way, SDT, as well as the Special Department of the High Court and the Special Police Department, would be relieved of the burden of dealing with corrupt criminal acts that objectively do not represent the greatest danger for society and the state”, according to the Government.
