President of the Constitutional Court, Desanka Lopičić, and judges Milorad Gogic, Dragoljub Draskovic, Hamdija Sharkinović, Budimir Scepanovic and Miodrag Iličković, agreed on July 24th this year to launch proceedings to check the constitutionality of the aforementioned decision. At the same time, they rejected the Eurofond’s request to cancel implementation of the decision before proceedings are concluded, writes Dan daily.
The proposal to review the constitutionality of the decision was, on behalf of the Fund (as majority owner of Solana’s land), filed by a defense attorney, Milan Vujosevic who said the Assembly adopted problematic amendments in an unconstitutional and illegal manner, making the decision void.
The proposal to review the constitutionality was filed on August 17th 2012, eight days after parliament’s decision was published in the Official Journal, and judging by reasoning of the Constitutional Court, it is expected that this parliamentary decision will be declared unconstitutional, writes the daily.
According to the Central Depository Agency, the owner of 73.8 percent of Solana is hidden behind the HB collective custody account, although, according to unofficial information, the true owner is Eurofond where Barović, according to CDA data, has a 2.6 percent stake.
However, according to his counsel, lawyer Zoran Piperović, Barovic left Solana (Saltworks Ulcinj), a company from Ulcinj, for good. Mr Piperović the end of January last year said Barović left Eurofond and all companies in the portfolio of the Fund.
The Central Register of Business Entities, according to decision of the Tax Administration, made changes to update data, according to which the owners of Eurofond are: Armin Mulahusić, Boisha Shotra (as executive director), Fahrudin Kajošević, Milanko Damjanovic, Milic Popovic, Nenad Shtibilj, Vlatko Aprcović, Vuk Rajkovic and Euroinvest (Eurofond’s management).
