Djokaj: Ministry should explain how waiters are entitled to process personal data

In a statement for Pobjeda daily, a member of the Agency for Protection of Personal Data’s Council, Muhamed Djokaj, urged the Ministry of Health to explain how come that waiters in hospitality venues have the right to have an insight into Covid certificates and personal data of citizens that want to enter the place. 

Mr Djokaj asked this following numerous questions of citizens, requesting to know the legal grounds of such ministry’s decision, that is, laws according to which the ministry enabled this check of personal data.

“On the website of the ministry I couldn’t find a measure or order that precises, that is, points out to an article of the law which enables waiters to have an insight into this type of data – Covid certificate – which is, according to the ministry, valid only with an ID or passport.”

He continued: “If there are no adequate grounds, citizens can sue all those who require them to show and process the aforementioned information, that is, data that belong to the special category, as they’re health-related information.”
