Employers can give part of salaries directly

Labour inspection cannot control employers who pay workers directly in cash if they are paying taxes for the minimal wage of 193 EUR, it was said to Pobjeda daily from Directorate for inspection.

“Part of the salary that the employer and employee agree on verbally, aside from contract of work, and that is paid directly in cash, cannot be visible to Labour inspection, so the inspection cannot control such situations”, it was explained from the Directorate.

They did not say if there were reports of workers who receive insurance for minimal wage while the rest of the salary is handed in cash. Union constantly points to this issue in public.

President of the Union of free syndicates Srdja Kekovic recently said to Pobjeda daily that most employers in priate sector pay only the minimal wage according to the law. The rest of the salaries they pay in cash, illegally, which makes the employers lose pension insurance, and the state loses from its state budget and social funds.

Judging by Inspection’s statement that this problem is invisible to them, it seems that it cannot be solved.

The inspection that controls salaries and other income stated to Pobjeda that they do not have evidence that any employee working full time has not received less than minimum wage.

They also said that they regularly report to Tax administration any irregularity they discover.

They reminded of a provision in the Law on labour, that stipulates that the employer must give a receipt to the employee when calculating earnings.

They also reminded that the control of calculations and payment of contributions fall under Tax administration authority.

“Employees can refer to them, with a receipt of their earnings, in order to check obligations employer has to them”, Directorate explained.
