According to the Ministry of Capital Investment, seven concession contracts for the construction of small hydro power plants have been cancelled, as concessionaires failed to comply with obligations. Concessionaires, on the other hand, disagree with this assessment having in mind that four of them have so far filed lawsuits for compensation of a damage, and one for annulment of a contract by mutual agreement concluded in 2019. The ministry, however, doesn’t know much this would cost the state, reports Pobjeda, a daily.
“All seven contracts were unilaterally terminated due to non-compliance with contractual obligations by the concessionaire. We emphasize that this Government has not undertaken to reimburse anyone for any cost based on the afore-mentioned terminations, but it does not necessarily mean that it won’t have to pay in the end, as everything depends on the court ruling.”
They reminded that the government unilaterally ended all seven contracts at the session held on 29 December last year.
The consortiums Plava Hydro Power, Bistrica Clean Energy, Hydra and Dekar have settled the lawsuit.
